When SCRRA and Connex bring $600 million to the table, THEN the lawyers can talk turkey.

One of the readers who responded to this LA TIMES article asked whether anyone at Metrolink has been fired or, at the very minimum, had a pension withheld. Well, let's see: David Solow received a demotion but not a pay decrease and SCRRA is, as far as I know, still paying a portion of his home mortgage as part of the "package deal" that lured him out to CA from his native NJ. Oh yeah, and they also named a control point after him in Laguna Niguel.

Metrolink to offer $200-million settlement to victims of deadly Chatsworth rail disaster
August 25, 2010 | 12:53 pm

Metrolink and its former commuter train operating contractor will offer $200 million to victims and survivors of the 2008 Chatsworth rail disaster under a plan expected to be filed in federal court as early as Wednesday, The Times has learned.

The offer equals the maximum liability established under federal law for passenger train accidents and would be among the most costly rail catastrophe payouts in the nation’s history.

But the proposal is likely to be challenged by victims and their attorneys, who say total medical and other damages caused by 24 deaths and injuries to 135 passengers far exceeds $200 million.

The distribution of the funds, expected to be drawn partly from insurance payments, would be left to the courts, assuming the plan receives judicial approval.

The head-on crash was caused by a contract Metrolink engineer, employed by Connex Railroad, who ran a red light while text messaging on a cellphone, according to the National Transportation Safety Board.

Officials with the five-county commuter system say the settlement plan, coming weeks before the second anniversary of the crash, conforms to federal requirements and would speed up financial relief to injured passengers and relatives of those killed.
“It provides compensation to the victims on an expedited basis, potentially years faster than if the case was fully litigated,” said Metrolink board Chairman Keith Millhouse.

Victims attorneys did not have an immediate comment, but were planning to release a statement once the proposal is filed.

“This covers only between a third and a half of the true damages,” said one victims’ attorney, who spoke on the condition he not be named because he wasn’t authorized to speak for the plaintiffs’ group. “Taxpayers ultimately will have to bear the burden of the rest.”

The Metrolink-Connex settlement offer could set off a legal and possibly legislative battle over the federal liability cap, as it applies to the Chatsworth accident. The cap was adopted by Congress in 1997 to help keep the nation’s passenger rail system financially viable.

BNSF slows down a key Amtrak route

Friday, August 20, 2010

LA JUNTA, Colo. — A 60-mph speed limit was abruptly imposed this week on 180 miles of BNSF Railway track used by Amtrak's Southwest Chief, effectively creating a 40-plus-minute delay for the Chicago-Los Angeles passenger train. And Amtrak must pay the bill if it wants the previous 79-mph speed for passenger trains restored.

The restriction came after a BNSF office-car train inspecting the route on Aug. 19 encountered unacceptably rough track at speeds somewhat less than 70 mph. The first eastbound Southwest Chief reported a 43-minute delay negotiating the speed restrictions.

Areas affected are from Hutchinson, Kan., to 22 miles west of that city, from east of Dodge City, Kan., to west of Garden City, Kan., and from Syracuse, Kan., to Las Animas, N.M.

Early indications are that the track conditions are caused by wear and tear on 60- and 70-year-old 132-pound jointed rail. As rail nears the end of its useful life, the ends tend to bend down, creating a depression at every joint.

Terms of its contract with Amtrak allowed BNSF to begin maintaining the track between Newton, Kan., and La Junta, Colo., 365 miles, for 40-mph speeds for both freight and passenger trains beginning last Jan. 1. Amtrak agreed to pay the incremental cost of keeping the track maintained for 79-mph operation.

Unfortunately, the only cure for worn rail is sometimes either permanently slower speeds or replacement. To replace 180 miles of track with welded rail would cost millions.

BNSF has offered, as an alternative, to let Amtrak permanently reroute the Southwest Chief between Newton and Albuquerque, N.M., over its freight-only line via Wichita, Kan., Amarillo, Texas, and Clovis, N.M. Amtrak President Joseph Boardman has publicly said he is uninterested in such an arrangement. - Fred W. Frailey

From what I understand, there is an effort to sweep the fact that she was on the head end under the carpet. I think that's BS. If one hangs, they should all hang.
Thinking at Amtrak is subservient to technicalities. Better to spend $300 with perfect receipts then $23.75 with make shift but 100% honest receipts. Sunday night 13 passengers walked in to the OSD station telling me that due conductor error the doors did not open for them in time at SOL. Perhaps the incident on the platform at SOL and the train full of race fans distracted the conductors from opening this particular door. The time was about 725pm.

The options were as follows:

1) Apologize and have them wait until S/B 590 could take them back to SOL at 903pm by my walking them out tot he train and getting them on. i did mention this option.

2) Taxi them (an often very expensive Amtrak way but used a lot but with 13 people close to $300 (3-4 taxis needed, plus getting an OK, etc, etc)

3) Last S/B bus #101 to SOL would be leaving in a few minutes from the transit center adjacent to the station at 7:33pm. Problem, perfect receipts not available as transfers no longer issued on buses, only day passes and these are $5/person. With 10 regular people and 3 seniors the bus would cost $23.75 for everybody and they would be on their way right away.

I took the last option as it would get them on their way quickly. I typed out a form for the leader of the group to sign, attached the ticket stubs from those who had them (about 5 or so) and turned this in on a Miscellaneous Station Expense with my days work with a post it note that perhaps it might be better to put it on a new cash item (Form 638)

The next day when I came to work I was told that I shorted $23.75 as I did not have a "proper" receipt and was told that perhaps I should have cabbed them. I mentioned that this would cost $300 or so. I was told that they don't care about this, only the receipts. IS IT A WONDER WHY AMTRAK WILL NEVER BE SUCCESSFUL. Better to collect from an employee rather than reward customer service saving the company $275!

We are booked for a trip, Chicago-Havre MT in early November. I booked a Superliner Roomette for the westbound portion because the price for a bedroom was outrageous (IMO). I have heard that when you upgrade on the train, you can get a room at a discounted rate. Is there any truth to this?
If a bedroom would become available due to a no-show or last minute cancellation, it would be great to get it...cheap! Maybe I'm looking for too much from Amtrak here? Thanks for viewing.
Gary

Author: AmtrakOBSCrew
Please keep in mind that the conductors primary job is the safe operation of the train. He/she has a lot more important things to do than to sell rooms to bargain hunters. Amtrak has several hundred ticket agents located in stations across the country for the purpose of handling ticketing matters in their station, not to mention thousands of reservation agents at the three call centers across the country. Most conductors will not sell en-route upgrades for that reason. Don't bother the conductors.

Also keep in mind that when you all switch from coach to sleeper at the last minute and start getting your meals included in the diner, guess what happens. They start to run out. Trains are stocked according to the number of people the manifest shows. If the Southwest Chief's manifest leaving Chicago shows an average of 60 in the sleeper per meal and then it increases by MORE THAN A REASONABLE amount, menu items sell out. There is nowhere to re-stock en-route. Contract agreement with Aramark, Amtrak's food service provider prohibits the purchasing of food from any other source then themselves and they are only located in major cities such as LAX, CHI,NOL,SEA,OKJ,ALB,NYP,MIA,WAS, & BOS.

Author: aehouse
In Pre-Amtrak days, conductors were pleased to upgrade passengers. This response is illustrative of the old adage that we could run the trains on time if we didn't have to stop for the passengers.

Conductors are empowered by Amtrak to sell the space; there's no excuse (other than laziness) for their refusal to cooperate. Can you imagine a train manager on the Canadian (where they don't even use conductors) refusing to cooperate with a passenger who wanted to increase revenue by upgrading? Geeeeze.

The nonsense about dining car meals is just that. Coach passengers are entitled to purchase a dining car meal, so Amtrak needs to plan for that eventuality as much as it does for sleeping car passengers to use the diner.

If I tried to upgrade and received no cooperation, I'd be on the (cell) phone with Amtrak straightaway to try to book a room out of the next station, AND to make a complaint.

Author: Abqfoamer
OBS Person.... Uh, excuse me, mister ARROGANT, "don't bother the conductors"??? Sounds like you hate your job. Go work somewhere else, but not with the public!!

Your attitude is one of the reasons I don't use Amtrak.

Author: Woodman
Then if the conductor can't be bothered, then why does Amtrak tell you to ask him for an upgrade?

Author: toledopatch
Simply put, Amtrak conductors who don't want to be bothered with selling accommodations, or otherwise dealing with passengers, should go back to working freight.

So has anyone else gotten the ballot in the mail from the BLET? In a nutshell, they want us to vote away our right to a vote. They are asking us to change the bylaws so that we the membership do not get to vote as a whole for things. Rather, we would vote on an issue or person at a local level, then out local elected officials would bring that vote to a national level.

I think its a bunch of bullshit and another way for our union to take away control from the membership.

We already know our local elected officials can't be trusted to vote how we want them to... That's one of the reasons Mark Kenny is still in office.

Also, they say it will save $16,000 from having to mail us all ballots. That's chump change!!!! Did you know that some of the national level officials have a $500,000 annual expense account??? $16K ain't shit to the them.

If you haven't already done so, please vote NO on the bylaws change.
